Case: US Consumer Brand Blocked at Tmall — 4-Month Trademark Rescue

CLIENT CASE — KEY POINTS

A US lifestyle brand found its Chinese name trademark squatted by a former distributor, blocking Tmall verification. A combined invalidation + defensive filing + negotiated buyout strategy cleared the path in 4 months instead of the 2 years litigation would have taken.

Situation: the brand filed Tmall verification and was rejected — a Zhejiang trading company held the Chinese-character trademark, registered 3 years earlier by the brand's former distributor. Litigation estimate: 18-24 months. Actions: (1) Filed a 3-year non-use cancellation on the squatter's mark while gathering use-evidence. (2) Simultaneously filed new applications covering the brand's English mark, transliteration variants, and adjacent classes. (3) Opened a negotiation track backed by the invalidation filing — the squatter's position weakened as evidence of non-use accumulated. Outcome: buyout settled at 6% of the initially demanded price, new filings proceeded to registration, Tmall store approved month 4. Lesson: platform verification turns trademarks into hard gates; the file-before-launch rule is not a formality, and a parallel-track strategy (cancel + file + negotiate) beats pure litigation almost every time.
